By accessing or using the Site or Services, or by placing an order, you agree to be bound by these Terms and Conditions, our Privacy Policy, Refund Policy, and any other policies referenced herein. If you do not agree, you must not use the Site or Services.

We may revise these Terms at any time. The updated version will be posted on this page with a revised “Last updated” date. Material changes will be notified via the Site or email where feasible. Your continued use after changes constitutes acceptance.
## 3. Eligibility and Use
You must be at least 18 years old and have the legal capacity to enter contracts to use our Services. By using the Site or placing an order, you represent that you meet these requirements.
## 4. Services Description
We provide custom window treatments including roller shades (blackout, zebra, etc.), custom blinds, shades, drapery, and related products. Services include: - Free in-home consultations and professional measurements - Custom design/fabrication (often in our own facility) - Professional installation (residential and commercial)
All products are custom-made to your specifications. We do not sell mass-produced, ready-made items.
## 5. Ordering and Payment
- Quotes are estimates based on measurements and selections; final price may vary after precise measurement or material changes. - A deposit (typically 50% or as quoted) is required to begin fabrication. Remaining balance is due upon installation completion or as agreed. - Payments are accepted via [list methods: credit card, check, etc.]. We may use third-party processors; their terms also apply. - All sales are final for custom goods unless covered under our Refund Policy or required by law. - Prices are in USD and exclude applicable sales tax unless stated.
## 6. Custom Orders and Changes
Custom products are made-to-order and non-returnable/non-refundable except as provided in our Refund Policy or for manufacturing defects. Order changes after production begins may incur fees or delays.
## 7. Installation and Measurements
- We provide professional installation as part of most orders. - Accurate measurements are critical; we recommend our in-home measurement service. Customer-provided measurements are used at your risk. - Installation requires safe, accessible worksite conditions. Additional charges may apply for complications (e.g., high windows, difficult access). - We are not liable for property damage caused by pre-existing conditions or improper site preparation.
## 8. Warranties and Guarantees
We stand behind our workmanship, materials, fabrication, motors, and mechanisms with a guarantee as described on the Site or in your quote/contract. This is a limited warranty; normal wear, misuse, improper cleaning, or acts of God are excluded.
Third-party components (e.g., motors) carry manufacturer warranties only.
Products are sold “AS IS” except for express warranties provided.
## 9. Limitation of Liability
To the fullest extent permitted by law, Blinds and Walls, its owners, employees, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages (including lost profits or data) arising from use of the Site/Services or products.
Our total liability shall not exceed the amount paid by you for the specific order giving rise to the claim.
We are not liable for delays due to supply chain issues, weather, or events beyond our control.
## 10. Indemnification
You agree to indemnify and hold us harmless from claims arising from your breach of these Terms, misuse of products, or inaccurate information provided (e.g., measurements).
## 11. Intellectual Property
The Site, content, photos, designs, and logos are our property or licensed to us. You may not copy, reproduce, or use them without written permission (except for personal, non-commercial viewing).
## 12. Termination
We may suspend or terminate access to the Site/Services or cancel orders for violation of these Terms, non-payment, or at our discretion.
## 13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles.
Any disputes shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida. You waive any objection to venue or inconvenience of forum.
